Item A ATUAÇÃO DO JUDICIÁRIO TRABALHISTA E A PRECARIZAÇÃO DO TRABALHO: as decisões do TST e TRT do Maranhão e sua relação com a terceirização e flexibilização do trabalho(Universidade Federal do Maranhão, 2008-06-27) Arruda, Kátia Magalhães; LOPES, Josefa Batista; CPF:02749530300The Judicial Power and the precarization of labor. Reflection of judicial decisions in social life has not been approached with the importance the matter requires, especially where the relations resulting from the conflicts between capital and work are concerned. The purpose of this paper is to draw the attention to decisions made by the Labour Federal High Court and the Regional Labour Court in Maranhão relative to precarious labour in Brazil, with emphasis on aspects such as contracting out, flexibilization of rights, poor health and hygienic conditions of workers and degrading work, which, sometimes, reaches the boundaries of slavery. The judicial posture adopted by the Labour Justice seeks to strike a balance between protecting the worker and preserving the company. Considering that the Judicial Power is part of the capitalist State, accomplishing that goal is questionable. In despite of that, the Labour Justice has developed and established itself as the branch of the Judiciary closest to social issues, not only when it plays the role of a mediator between individual and collective conflicts, but also when it, through its judges, prevents the fraud to the employment protection legislation. It can be concluded that the decisions of the Judicial Power based on constitutional principles and rules of employment protection and dignity of human being contribute to the effectiviness of labour rights.Item O PROCESSO CONSTITUINTE EM FORMAS ESTATAIS REGIONAIS: a experiência da União Européia e do Mercosul(Universidade Federal do Maranhão, 2008-07-07) Aquino, Maria da Glória Costa Gonçalves de Sousa; FARIAS, Flávio Bezerra de; CPF:12425168320; http://lattes.cnpq.br/5147139035222233Study on the process of constituent formation in the European Union and in the Mercosouth, which puts the formalization of a Constitution at regional level. It breaks of an analysis of the historical context marked by the development of a new world-wide order based on the expansion of capitalism, trying to identify the deep economical, political and ideological transformations caused by the globalization movement and the internationalization of the capital, which has provoked mutations in the nature and functions of the national States, that are part of the global state forms regionally stablished, especifically on the cases of the European Union and Mercosouth. It is analysed as it took place to creation, construction and enlargement of the process of integration of member States of the European Union, determining its institutional-legal landmark, which provided with an opportunity for the preparation of the European Constitution, besides were identified the forms of structural and government development caused by this integration process, that has a much more political sense , under the European perspective, than properly legally. The embryonic form of the integration process of Mercosouth State members is described and the structural and governmental forms inherent to its constitution are highlighted. It observes the logic of formation of the constituent process which makes the elaboration of a Constitution for the economical block of the Mercosouth feasiable. A comparative study is made concerning the process of constituent formation on various state forms, used on the European Union and Mercosouth. It is concluded by evidencencing the strength process of sovereign States which compose the European Union and the Mercosouth, in spite of the natural structural tendency of these blocks which propitiates a legitimation crisis on the constitution process of these state forms.Item O DIREITO AO TRABALHO DECENTE : sonho ou realidade?(Universidade Federal do Maranhão, 2012-02-16) Monaco, Luigi Lo; GONÇALVES, Claudia Maria da Costa; CPF:33647175304; Sousa, Salviana de Maria Pastor Santos; CPF:04491920320; http://lattes.cnpq.br/8050800993055954The thesis we have developed is focused on the right to work "decent." This is a research and ethical reflection on the threat of economic "globalization" in Brazil. The right to work and work "decent" is situated in the larger context of human rights, the evolution of labor law and the current economic situation. The text prepared reports on the rise of the bourgeoisie and the capitalist exploitation of workers, since modernity, emphasizes the limits and the positive aspects of liberal constitutions and Brazilian constitutions since 1824 until 1988, stresses the importance of workers' struggles to defend the dignity of workers and their rights. The main hypothesis formulated by the author, who supervised the research, is that the new economic context of economic "globalization" of neoliberalism and social rights and the right to work "decent" are increasingly threatened. The completion of the study was the theoretical framework of historical materialism and, in consequence, the dialectical method to the apprehension of reality by unveiling the historical determinants present in social processes, which enables one to grasp Social Assistance as a process built. The methodological procedures used were based on literature review that allowed the theoretical and historical about the issue, search and document analysis, field research by conducting semi-structured interviews with managers, coaches and counselors and the focus group technique with users of Social Assistance. The text has initially considered the social formation in Brazilian and Maranhão as a reference for understanding the historical marks of inequality arising from the development of capitalism in Brazil and Maranhão reflecting on how social rights were constructed, in particular the right to Social Assistance. It addresses the basics of Social Services as a public policy in Brazil and Maranhão considering the periods before and after the 1988 Federal Constitution, the political and economic, social demands for Social Assistance and the responses of society and state. In the analysis of ruptures and continuities of Social Assistance in Brazil and Maranhão are considered the difficulties identified in the process of institutionalization as a component of the Brazilian Social Security. It highlighted the process of building policy in the 1990s under the liberal influence, which led to the implementation of a process of decentralization and municipalization of Social Assistance Policy without the creation of cooperative basis between the federal entities responsible for funding and management policy. It s still considered the context of recovery of the Organic Law of Social Assistance OLSA in the 2000s, as a parameter for creating the legal framework that shaped the institutionalization of the Unified Social Services - ITS. In this context, is considered the current debate about the concept of social welfare, and the difficulties of consolidation of ITS in Maranhão and Brazil, with an indication of elements that form ruptures and continuities of Social Assistance Policy with conservatism.Item O PROGRAMA DE DESENVOLVIMENTO DE FORNECEDORES DO ESTADO DO MARANHÃO (PDF-MA) EM QUESTÃO: Avaliando os processos de formulação e implementação de 1999 a 2007(Universidade Federal do Maranhão, 2013-03-05) Hossoé, Heric Santos; SILVA, José de Ribamar Sá; CPF:25093509353; Lima, Valéria Ferreira Santos de Almada; CPF:20765142368; http://lattes.cnpq.br/7758192020816194This dissertation focuses the formulation and implementation of the Supplier Development Program of the State of Maranhão. It is worth noting that this program emerges the need of big business and the state to offer a response to local entrepreneurs and society in order to integrate them into the supply chains of large companies. However, to this end, we draw the path from the change in the economy, taking as starting point the private sector, which adopts the restructuring process as this new flagship model, the unbundling of the leading chains of large companies, mainly through outsourcing, thus generating a strategy of regional specialization. Given these changes, turns to examine the paradigm in relation to the State, which is undergoing deep changes, culminating with the so-called Minimum or Neoliberal State. It should be emphasized that the evaluation of the MA-developed PDF is dynamic and want to go from the general international economic relations, through the reflections of these relations in Brazil, reaching the more specific, the program exposed. Finally, the study of the PDF-MA aims to detail the dynamics of the program, building a framework of indicators and developing the theme of Sustainable Development. To undertake such research were two moments evaluative, first we make a political assessment of the policy, so you can figure out the nuances and how its implementation was determined politically, understanding how the program came into the government's agenda and what subjects interest and rationalities involved. In the second, reveals the dynamics of implementation of this policy through an evaluation process, ensuring that the means used are appropriate to the desired ends and if it was able to change the situation that gave rise to the problem program. Along the way, we used a qualitative and quantitative approach, having as research techniques, literature and documentary mode. The data source is the Census of 2000 and 2010. In order to further investigate the phenomenon, we proceeded to the elaboration of an indicator called multidimensional Municipal Poverty Index for Maranhão (IPMM). First, we proceeded to the survey of the main explanatory approaches of the phenomenon of poverty and the main forms of measurement. It was then decided by multidimensional approach to poverty measurement purposes of the phenomenon, but without compromising the structural approach to understand their decisions and ways of overcoming. We decided to choose a multidimensional indicator due to the fact that it takes into account a larger number of indicators. Then, we described the methodology of the Index and the results have been described for both the index and for the six dimensions that comprise it. The main conclusions that came with the construction of IPMM were: a) there was a reduction in poverty both in the state of Maranhão as in all other cities, as we compare the years 2000 and 2010, b) the performance of municipalities was not homogeneous, c) the degree of poverty seems to be more intense at the municipal level than at state d) the most advanced dimensions were: access to the knowledge, child development and housing needs, whereas the least advanced were: access to work and lack of resources. Thus, the evolution of poverty in the municipalities of Maranhão in the first decade of the 2000s was not the result of endogenous factors to the growth pattern exhibited by the economy of Maranhão in this period.Item COOPERATIVISMO NOS PROCESSOS DE ORGANIZAÇÃO POLÍTICA E ECONÔMICA DOS TRABALHADORES NA LUTA CONTRA A EXPROPRIAÇÃO CAPITALISTA NO CAMPO: a resistência do Movimento dos Trabalhadores Rurais Sem Terra no Maranhão(Universidade Federal do Maranhão, 2014-05-27) TORREÃO, Marlene Corrêa; ABREU, Marina Maciel; CPF:12542334This is a study on cooperativism in the current economic and political organization of workers, having as reference the resistance waged by the MST in Maranhão. The historical background of the study is disclosed, presenting the cooperativism as a contradictory tool on the workers struggling process, to the extent that its determinants present two perspectives: one used in the free market idealistic proposals presenting a political and ideological dimension that meet capitalist interests, being currently updated in the processes of flexibilization work; the other, expresses an alternative of resistance and struggle of the workers, which might be an important tool in the context of social struggles, if it is consciously constituted. A historical recovery of cooperativism, is also carried out, as one of the models of agricultural cooperation organized by the MST since the 1980s, when there was an intense worsening of the agrarian question due to the advancement of capitalism in the countryside. The study considers the cooperativism as a major instrument of political and economic organization for farmers, even though in Maranhão this initiative has shown weakness in relation to the economic return to the cooperative members. The main limits pointed out by the leaders in the production sector of the movement, have been: technical and managerial difficulties, lack of production technologies, as well as little support given by the State through public policies that generally follow the logic of the current agricultural policy, allowing the landowner to be the major beneficiary of public funds. The study identifies that somehow, politically, the cooperativism has contributed to the process of resistance within the MST, provided that it has led to the formation of new concepts about the organization of production and labor relations, even though this strategy is posed in a contradictory way.Item UM ESTUDO DA POLÍTICA DE ATENÇÃO BÁSICA NO BRASIL: a particularidade da Estratégia Saúde da Família(Universidade Federal do Maranhão, 2015-03-05) Carreiro, Paula Katiana da Silva; DIAS, Marly de Jesus Sá; CPF:27044475353; http://lattes.cnpq.br/0576152814937497; Sousa, Salviana de Maria Pastor Santos; CPF:04491920320; http://lattes.cnpq.br/8050800993055954The Family Health Strategy (FHS) is born as a program in 1994 and has the intention to change the current health care model based on the healing of diseases for those in which the prevention and health promotion is the main focus. The survey, entitled A Study of the Basic Policy Attention in Brazil: the particularity of the Family Health Strategy, aimed to make a political evaluation of the policy in order to develop an analysis of the FHS making process, considering its theoretical structure, the arguments of political, economic, social and cultural order that it claimed, seeking to make a mutual comparison between the design of this policy and the general principles and objectives envisaged in the regulations that establish the health policy in Brazil, particularly the basic attention policy proposed in the management model of the Unified Health System (SUS). Therefore, drew up a historical trajectory of this policy, in which could be observed a transition from the sanitarian, campaigner and hygienist model for the universal health care model envisaged by Unified Health System, influenced by the proposals of the Sanitary Reform. It is estimated, from this historical overview, the ethical-political framework considered by the makers of the Family Health, and the consistency and relevance of the proposal in relation to engineering drawn by the developers.Item A EDUCAÇÃO PROFISSIONAL E A POLÍTICA PÚBLICA MULHERES MIL: a implementação no âmbito do IFMA em São Luís(Universidade Federal do Maranhão, 2015-03-11) Silva, Tássia Mendes e; COSTA, Cândida da; CPF:27994859387; http://lattes.cnpq.br/8455814155563851This work intended to study public policy Thousand Women from the experience of the Federal Institute of Maranhão, São Luís, from 2009 to 2012, which was aimed at raising the educational level and the qualification of participants. It was an inclusive public policy, with a gender approach, geared to the provision of vocational training courses, which sought to provide women in vulnerable social conditions access to education, qualifications, employment and income through vocational training and citizen. This paper considered the historical inequalities faced by women in Brazilian society, particularly with regard to access to education, qualification and entry into the labor market. The research was of bibliographical and documentary evidence, to identify the key aspects in government discourse and verification of what happened in the concrete reality of the students of the courses. A theoretical review was carried out on the main categories present in this policy, such as education, professional training, citizenship, sustainable development, equity, work, public policy and gender. Was achieved as a result note that the actions taken in this policy achieved some objectives pursued without getting the complete success of its initial proposal, as the rise of education and the integration into the majority of the labor market of the students, although it was for some students important for raising the self-esteem, to return to their studies and to enter the job market.Item GERAÇÃO DE RENDA PARA AS MULHERES: uma avaliação de impactos do Programa Mulheres Mil na ótica de egressas em São Luís/MA(Universidade Federal do Maranhão, 2015-03-11) Nascimento, Sara Diniz; DIAS, Marly de Jesus Sá; CPF:27044475353; http://lattes.cnpq.br/0576152814937497; Lima, Valéria Ferreira Santos de Almada; CPF:20765142368; http://lattes.cnpq.br/7758192020816194Génération de revenu pour les femmes. Évaluation d'impact du Programme Femmes Mille dans l'optique des diplômées à São Luís/MA. Il se cherche à évaluer les impacts dans des termes de génération de revenu pour des femmes dans situation de vulnérabilité qui ont été qualifiées par ledit programme développé dans IFMA/Campus Monte Château, dans la période de 2009 et 2013. La proposition de l'étude s'est guidée par l'accord des asymétries entre les sexes, construits dans les sociétés dans chaque temps historique. Le programme s'insère dans le contexte de réordonnance du capital, d'inspiration néolibérale, où les politiques publiques, guidées par les avis de la Banque Mondiale, sont à remplacer par l'approche dans des programmes de combat à la pauvreté, mais, avec caractère simplement compensatoire. D‟après des données soulevées il s'est prouvé que le Programme Femmes Mille a contribué aux femmes dans des termes de motivation et à d'autoestima. Le costume de pouvoir fréquenter un espace scolaire et une convivalité avec autres personnes, outre son cercle familier, a représenté, dans certain mesurée, la possibilité d'extrapoler l'espace domestique. Concernant l' insertion dans le monde du travail il s'est représenté que à la majorité des femmes il est inséré dans des activités différentes de la qualification réalisée. Il s'est perçu que l'impact dans le revenu des femmes après la qualification réalisée encore est suffisamment timide. Le simple accès à des actions de qualification et l'insertion dans le monde du travail ne peuvent décider de lui-même les problèmes d'inégalités sociales qui atteignent les femmes, donc elles s'écoulent des relations le plus suffisant de production et de reproduction sociale. Ainsi, l'évaluation d'impacts est importante instrument qui peut contribuer dans le changement de l'exécution du programme, avec des vues la plus grande efficacité.Item DO CANTO DE SEREIA AO PRESENTE GREGO: análise da responsabilidade social empresarial da Vale a partir do Programa Ação Educação no Maranhão, no período de 2012-2014(Universidade Federal do Maranhão, 2015-06-12) Santos, Neuziane Sousa dos; SANT'ANA JÚNIOR, Horário Antunes de; CPF:30932149120; http://lattes.cnpq.br/5137817404959463Analyzes the Education Action Program funded by Vale S / A, in Maranhão, from 2012. It shows that the program is a Corporate Social Responsibility Action (CSR), which works in partnership system within the third sector . The Education Action comprises two actions: one directs to the training of managers of public schools in Açailândia the municipality and the other, intended for training of staff of the Secretariat of the Municipality of Bom Jesus jungles of Education. On the relationships established within that program, are speeches that apparently seem to be endowed action coherence and linearity and contradictory practices that deny speech. Wonders whether the speech and the practice of social responsibility of Vale, through its historical determinants. Therefore, to obtain results, we used authors who interpret CSR as an ideological process in order to interpret the CSR Valley as a reductive ideological strategy of socio-environmental conflicts in communities headquarters of the Education Action Programme, because of the unbridled search for profit of the company.Item Velhice(s) e lazer(es): a representação do lazer por velhas e velhos integrantes do Programa de Ação Integrada para o Aposentado (PAI) em São Luís/MA(Universidade Federal do Maranhão, 2016-03-16) Leite, Ângela Roberta Lucas; ARAÚJO, Maria do Socorro Sousa de; 336.691.473-49The representation of leisure by old women and men integrants of the Program of Integrated Action for Retired People (PAI) in São Luís/MA. I analyze the social representations on leisure (in) for the elderness through the perceptions that old women and old men, participants of activities in the PAI, activate about leisure while participating or not in the activities. The research methodology used was the qualitative approach, conducted during the period of March, 2014 to March, 2016, in which the empirical referential was the Program of Integrated Action for Retired People, the PAI, in the municipality of São Luís. I performed a bibliographical research on the guiding categories oldness and leisure from Pierre Bourdieu’s theoretical-methodological tools that understand the categories as social construction. Thus, categories leisure (s) and oldness (es) are understood as regions, that may be activated from different criteria; and also documentary research aiming to identify in the PAI’s written proposals the representations of leisure and oldness; and identify the activities that are considered leisure that were developed by the PAI. The participant’s observation, semi-structured interviews and informal conversations were also used as data collection source. The interviews covered 14 old women and men, retired from Maranhão’s Public State Service, that attended the recreational activities at least for one year in continuous way. Through the interviews with old women and men the intention was to identify the social representations that are presented about leisure and oldness; I conducted, also, interviews with five contributors (one supervisor and four social workers) who were responsible for planning and organization of the PAI activities, to an intention to understand the representation the contributors present about leisure and oldness. From the data collected on the interview, it was possible to detect how the activities developed by the PAI are ellaborated and that all of them are fraught by the conceptions of leisure. Through the performed interviews it was possible to identify old women and men’s representation of themselves and their perception of leisure. I conclude that the experiences of being old, of living leisure at the PAI and of experiencing the leisure activities in old age inside and outside PAI space take on meanings from dimensions of time, behavior and space. Thereby, experience of leisure doesn’t just happen on purposeful bases such as time and activity space developed in PAI, and therefore, subjective aspects like behavior, tastes, preferences and lifestyles of this social group must be taken into consideration.Item A Resex de Tauá-Mirim e seus rizomas: um trabalho de construção coletiva e etnografia do processo(Universidade Federal do Maranhão, 2016-03-21) Damasceno, Elena Steinhorst; SANT'ANA JÚNIOR, Horário Antunes de; 309.321.491-20Este trabajo es el resultado de las investigaciones llevadas a cabo por una red de grupos académicos y movimientos sociales, organizados como un rizoma, los practicantes de la transformación de la realidad objetiva se estudia. Dado que las metodologías se utilizan multivocalidad de los investigadores del Grupo de Estudio: Desarrollo, Modernidad y Medio Ambiente (GEDMMA) y sus socios, el establecimiento de un trabajo colectivo de construcción del conocimiento; y la etnografía del proceso, para llevar a cabo la investigación en el proceso que está siendo procesado en la Corte Federal para la terminación del Ministerio Público Federal (MPF), por los retrasos en la ejecución legal de la Reserva Extractivas (RESEX) Tauá Mirim, Sao Luís – MA, y genera los llamados conflictos ambientales entre las comunidades secularmente establecidos y grandes proyectos de desarrollo. El trabajo se divide en ATOS y momentos que pretenden demostrar, a través de una arquitectura, un proceso efervescente y dramática de la lucha de los pueblos y comunidades tradicionales para el mantenimiento de su territorio y la conservación de la naturaleza concomitante.Item GÊNERO, TRÁFICO SEXUAL DE MULHERES E POLÍTICAS PÚBLICAS: uma análise da experiência da Secretaria de Políticas para as Mulheres da Presidência da República (SPM/PR)(Universidade Federal do Maranhão, 2017-03-22) LIMA, Thiago Pereira; ROCHA, Lourdes de Maria Leitão Nunes; 216594863-00; http://lattes.cnpq.br/7295015708722425The women‘s sexual traffic presents as one practice that occurs in several countries, in different scales and dynamics. The debate about public policies of traffic‘s fighting emerge in the end of 20‘s century, with the Additional Protocol to the United Nations Convention against Transnational Organized Crime related to the prevention, repression and punishment of Trafficking Persons, in special Women and Children - the Palermo Protocol (2000). Brazil has been influenced by the Palermo Protocol and builds the National Policy in Fighting the Traffic of People (2006), the 1st National Plan in Fighting the Traffic of People (2008) and the 2nd National Plan in Fighting the Traffic of People (2013). The thesis argues the assumptions that demonstrates the national and supranational legal devices, as well as the Brazilian public policies in fighting the women‘s sexual traffic, taking into account as the perspective of gender that has been built on debate. Therefore, taking as reference, the international documents that Brazil was signatory over 20‘s century, the Palermo Protocol (2000), the Brazilian policies developed in the first decade of 21‘s century, from the National Policy in Fighting the Traffic of People, the 1st National Plan in Fighting the Traffic of People and the 2nd National Plan in Fighting the Traffic of People, as well as interviews with official policies as the Women‘s Secretariat of Policies (SPM/PR) and Ministry of Justice (MJ) and the Human Rights Secretariat (SEDH). I analyze the speech and actions developed by the Women‘s Secretariat of Policies of the Presidency of the Republic (SPM/PR), created in 2003, on the scope of Federal Government to develop state‘s policies to reach the fightning related to the violence against women. According with the empirical datas and in a theoretical perspective in gender studies, I argue that public policies presents a gender perspective, limited to women and not in a relational perspective; there is a speech and generalized actions that don‘t meet the complex field of gender, according it shows the official reports and the interviews made with the competent bodies. The speech and the actions in fighting the women‘s sexual traffic reproduces the international line and considering the traffic inside the actions in fighting the violence against women. The public policy creates movements of essentials, producing ambiguous effects, due to the same time, it meets the needs of vulnerable segments, as women, and in the other side, it doesn‘t meets the plurality.Item PROGRAMA BRASIL CARINHOSO: uma análise no contexto de reconfiguração da Política Social e no atendimento das demandas das mulheres-mães em São Luís/MA(Universidade Federal do Maranhão, 2017-04-18) FRANÇA, Mariana Veras; DIAS, Marly de Jesus Sá; 270444753-53; http://lattes.cnpq.br/0576152814937497The BC is a federal government program aimed at early childhood, with the aim of stimulating the creation of day care centers and opening new places in existing day care centers for children aged 0-3 and thus reducing the inequality of access to education between the poor and the rich. It is part of the programs developed by the Social Assistance Policy in the context of reconfigurations of social policies under the impositions of neoliberal capital. The objective was to analyze this Program in São Luís-MA, in the current context of Social Assistance in relation to meeting the demands of women mothers and children from 0 to 6 years of age by daycare centers in the period from 2012 to 2015. It counted on the contribution (1 public and 2 community) located in the neighborhoods of Palmeira Village, Guardian Angel and Embratel Village, 12 mothers-women with children aged 0-6 enrolled in PBF-BC and 2 representatives of the Municipal Secretariat of Education of São Luís (SEMED) and 3 pedagogical directors/coordinators of the day care centers. The conception of day care that guided the study was public policy, social and universal right of urban and rural workers (and) and children up to 5 years of age to education, which has the duty of the State to guarantee it as a public good, free and of quality. This is a critical and qualitative study, which shows that daycare continues to be a "subpriority" of municipalities, and that the Program did not cover the historical demands, because parents still find it difficult to find places in public facilities, Which entails the transfer of responsibility of the municipality to private institutions, whether philanthropic or community. And these, in turn, also showed difficulties in receiving the encouragement of FUNDEB via BC. In order to understand the changes that have taken place in the University Hospital of Federal University of Maranhão (HU-UFMA), the work focus on the investigation of a single specific objective: the change management impact-analysis regarding to the education-research-extension university tripod, and therefore as these changes interfere in health care under the Unified Health System (SUS). The work traces the historical-social framework that created the conditions for a change in social production at the international level, how these changes directly af fect the national states, and the reform agenda in health care policies under the aegis of the World Bank. The underfunding process of health care is discussed, investigating the dispute and use of the public fund, and how the historical underfunding of the health care sector has direct implications for the universalization of health care access and quality of service offered. However, the issue is treated as a management problem, which the solution imposed by the government involves the introduction of "new management models", among them, the Brazilian Hospital Services Company (EBSERH). At last, the author conducts an impact analysis of the introduction of the EBSERH in the University Hospital (HU-UFMA) concerning the university tripod. Throughout the research, a historical overview of the right to health in Brazil is established, explaining how the brazilian Health System and other regulatory frameworks have been reached since the Federal Constitution of 1988. In addition, an analysis is made of the Ministry Public in Brazil, as an institution, as well as the existing instruments for extrajudicial action in the field of health, with emphasis on the design of new instruments, in addition to the existing ones, based on the need for resolutive and democratic action. Regarding the methodological course, in the qualitative research, the technical procedures used focused on the bibliographical and documentary research, complemented by a semi-structured interview and participant observation in the empirical space of the research. In the bibliographical research, we searched the works focused on the analysis of the theme, with focus for the Public Prosecution in the realization of the right to health; the documentary research was developed seeking administrative procedures in process at the 18th Specialized Justice Department of Defense for Health of São Luís, the empirical space of the research. For theoretical foundation of the investigation and the exposition of the results, Pierre Bourdieu was used, mainly the categories of field, symbolic power, symbolic violence and radical doubt; From Robert Alexy, we sought the weighting technique and Michael Foucault was considered his contribution in the order of the speech. Therefore, we engaged the development of a music video list from what was produced throughout those years to verify if its growth is related to the technologicals updates which we understand has favored access to the means of production and distribution of cultural products. The study is based on the theoretical approach of cultural materialism by Raymond Williams (1960, 1979, 2001, 2011) to see the audiovisual production as a cultural product and as a production process of that kind of product. Looking for realize that production as a consequence of changes in the social, cultural and economic structure that refers to the practices of independent music, we have call upon the idea of structure of feeling – from cultural materialism thesis – to understand those transformations. We turn to a brief history of the production of music videos that migrated from television to virtual platforms, especially YouTube. In order to understand the articulations in the virtual space, we address the comprehension of the media bios proposed by Sodré (2012) questioning democratization of the cultural goods. The social, cultural and economic transformations come from technological advances and the democratization of the means of production and distribution of cultural goods; these "new combinations" unbalance the economic logic of supply and demand. Thereby, it is necessary to understand the agents of culture - artists, musicians and audiovisual producers - as cultural entrepreneurs, managers of their own careers, perceiving art as business. Adopts as its assumption the Contemporary Capitalist State Theory and its determinations of nature and space, and the contradictory and complex involvement with social dumping in labor relations, as a prior phenomenon derived from the relentless practice of violation and denial of labor rights in order to achieve a potential advantage over competition. The question its analyzed from a Marxian perspective, through the use of historical-dialectical materialism and, therefore, we examine the historical designs that gives meaning to the Policy formulations as a state intervention. Thus, we start from a bibliographical and documental research, in order to allow the analysis of documents and data related do the Policy and its formulation process. Thus, it asks whether or not the policy has a propensity for naturalization and legitimation of social dumping through a state regulation practices, unfavorable to worker’s interests. It reflects about the process of institution of conciliation as a policy based on social-historical rescue that analyzes the idea of class conciliation as a culture with reflexes in the Labor Judiciary. It investigates the subject, their interests and rationalities and the way they express them in the Policy formulation process, trying to verify their influence degree on the Policy itself. It was assumed that the constitution of Science, Technology and Innovation in Health Policy in Brazil was a consequence of the effort to consolidate an international guideline that reinforced the concentration of capital and strengthened market failures in health, especially for neglected diseases, made explicit in the recommendations of International Organizations, fragile and sparce. The aforementioned Policy, in this sense, presented itself as a capitalist project of adjustment of the Brazilian State to the pressure of Internacional Organisms, having as main objective the insertion of the country in the global health market. Thus, starting from the comprehensive method, the methodological path started by understanding the determinations of the formulation process of the National Policy on Science, Technology and Innovation in Health, presenting the political-normative panorama that conditioned the institution of the policy, as well as the subjects who influenced the adoption of the National Policy on Science, Technology and Innovation in Health. The fundamentals of the Policy were also addressed, as well as the contradictions between the interests of the market industry and the rationality of the pharmaceutical industry in the face of confrontation neglected diseases. Finally, the process of building the Agenda for Priorites in Health research was demonstrated to face neglected diseases and the persistent reproduction of excluding capital in an international environment that favored the construction of Public Policies under international guidelines.
