L'objectif est de mettre en évidence comment les communautés ethniques et indigènes d'Équateur, de Bolivie et de Colombie ont conquis une série de droits qui garantissent la protection de la biodiversité, essentielle au développement de leur culture, de leurs traditions et de leur mode de vie, dans le but de les libérer du système monde colonial moderne et de leur permettre de jouer un rôle central dans la construction d'une nouvelle réalité juridique et politique en Amérique latine. L'approche est fondée sur la philosophie de la libération et la perspective marxiste, à travers le matérialisme historique-dialectique, qui cherche à retracer l'histoire de ces peuples, en reconnaissant l'importance de leurs luttes et résistances au fil des siècles. Le problème consiste à se demander comment les mouvements sociaux sont devenus des acteurs de la construction d'une nouvelle réalité juridique et politique. La recherche a un caractère transdisciplinaire, en tenant compte de la complexité des processus historico-culturels et des transformations vécues par la société dépendante latino-américaine. Le référentiel théorique s'appuie sur des auteurs adoptant la pensée décoloniale. The research is based on bibliography and documents, with a qualitative approach, with a critical perspective, using the method of historical-dialectical materialism. The assessment is based on the principle that housing is a social right to be ensured by the State, as provided for in the Federal Constitution, interpreting the Brazilian housing problem as a reflection of the social issue that manifests itself as a consequence of the capitalist model of production under conditions of national socio-historical formation, so that it affects the most impoverished segments of society more acutely. As a result, it is pointed out that the Casa Verde Amarela Program has little effectiveness in combating the housing problem in the country, and it does not promote the confrontation of the structuring issues that originate the problem. In relation to the social subjects and the interests involved in the formulation of the program, the reaffirmation of the historical tendency of satisfying the interests of Capital to the detriment of the guarantee of social rights can be seen, since the segments that had a preponderant influence in the formulation of the Program were mainly those linked to financial capital. The objective of the research that supported the Dissertation was to analyze the Program and identify the successes and obstacles in the operationalized forms of organization and management, considering the hierarchical and decision-making structure and the levels of federative members involved. Historically the country, has duality and political centralization as main characteristics, even when there is partial decentralization at the administrative level. Its general objective is to analyze the legal and political foundations in the formulation of the “Free Women” Project as a public policy aimed at reducing the vulnerability of families who have mothers deprived of their liberty, considering: the socio-historical context of the process of formulating the “Free Women Project.”; the legal and political references that supported the formulation of the policy, and finally, to evaluate the elements that constitute the policy, and the challenges to implement them. With a qualitative approach, it was used a bibliographic and documentary research, as well as secondary data analysis. Based on Bourdieu's reflexive sociology, in which it is understood that it is necessary to distinguish rigidity from scientific rigor, seeking to use the various methodological resources available in the various related contexts, and also in the analysis of discourse supported by Foucaultian literature, it is considered that the public policies aimed at maternity in the penal system are formulated in the context of different political and legal grounds and interests. But, this does not always occur in the traditional communities of which Bubaque Island in inserted, located in Bolama-Bijagós Archipelago in Guinea-Bissau, thus requiring an alternative tourism model that is committed to environmental, social, cultural and economic sustainability and equity in the distribution of benefits generated by tourism. In this sense, this research aims to analyze the tourism practiced in Bolama-Bijagós Archipelago, in relation to the conservation and preservation of natural resources and local cultures, based on sustainable use, with the full and effective participation of communities. As well as establishing the specific objectives: identify the impacts of tourism in Archipelago-Bolama/Bijagós, trace the process of formation of the state of Guinea-Bissau and its interference in public policies, carry out a survey of environmental, historical and cultural heritage (material and immaterial) that can be transformed into tourist attractions, investigate the tourist potential of the Bubaque Island for the realization of community-based tourism and assess the viability of preparing the proposal to implement and develop local community based tourism. For that, in the theoretical and conceptual framework, tourism and the Formation of the State of Guinea- Bissau were considered in the interference of political and institutional instability, consequently causing the lack of public policy for tourism and for the implementation of TBC in traditional communities; establishing the guiding principles for local development based on community-based tourism. The methodology used in this work is descriptive and exploratory, with bibliographical research, for which it was necessary to consult websites, books, theses, dissertations, articles, magazines and official documents. The results show that the environmental and cultural heritage (material and immaterial) are a daily register in the memories of the bijagós, in their relationship with nature; in relation to land ownership; in its connection with forests and sites; sacred places; in the historical fact that refer to Bijagó ancestry. It was discovered that there is still no national policy on tourism and community- based tourism. Its goal is to analyze the process of implementation of the course having as a parameter the educational principles listed in its Political-Pedagogical Project, which are based on the concept of field education elaborated from the field education movement. To this end, the investigation is guided by the dialectical historical materialism, which allows us to analyze this policy as part of a dialectical and contradictory totality, seeking to understand it in the context of a class society. The methodological procedures used were documentary research and semi-structured interviews with teachers and the articulating team of the course at the University. The data analysis was performed using the content analysis technique, referenced by Bardin (1977). The policy to train field educators is part of a counter-hegemonic project and is built from the dynamics of the class struggle that is inserted in the capitalist State, taking advantage of its fissures and contradictions. To understand this dynamic between State and civil society that crosses the composition of field education policies, we refer mainly to the works of Poulantzas (2015) and Gramsci (2020). As for the history and the foundations of field education, as well as for the analysis of the struggles for the formation of field educators, we resorted to authors such as Caldart (2003, 2004, 2008, 2010, 2011), Molina (2010, 2012, 2015, 2017), Molina and Antunes-Rocha (2014), Santos (2012), among others. On the configuration of public policies we used Arretche (2001) and Draibe (2001). In our empirical research, we took as a basis the Political Pedagogical Project of the Degree in Field Education of the Federal University of Maranhão (2014a, 2014b) from which we extracted the guiding principles of the analysis of its implementation. This project is based on a conception of field education originated in the struggles of peasant movements and defends a society that overcomes the division of classes, social inequalities, and the dichotomies between countryside and city, and especially the educational dichotomies, where there is a separation between intellectual and technical training, having labor as the educational principle. The results indicate that the Degree in Field Education at UFMA faces several tensions in order to consolidate itself in the university space as a course whose training points to a new human and societal referential, where the field is freed from the different fences that cross it: whether those of the latifundium or those of knowledge. The research was carried out with female employees from the Federal Institute of Science and Technology of Maranhão (IFMA), aiming to identify the configurations of harassment experienced by them in the work environment, its implications, as well as the ways of dealing with this violence, both by the victims and also by the Institution. So, the methodological path was guided by dialectical historical materialist method, as a basis for investigation and analysis, from which we can highlight these central categories: work, gender, violence and harassment. The investigation has a predominantly qualitative character, although it also has a quantitative data source, constituted by means of bibliographic and documental research that subsidized the analysis of the data collected in the field research, which was done by applying online questionnaires to 190 female employees from 28 campuses and the rectory. Based on theoretical ground, harassment was identified as a reconfiguration of violence at work, seeing that mechanisms of violence are used against workers since the most remote times. It so happens that the capitalist system, under the current neoliberal orientation, adopts work management strategies that encourage disputes, conflicts, competitiveness, individualism, struggle for places, resulting the weakening of the ties between workers. That fact is confirmed by the research data when it reveals that the moral harassment has been practiced mostly by men gender, causing often irreversible implications to the victims physical and mental health. Barriers were observed to confronting harassment by the workers who, for the most part, are not able to formalize complaints, but also by the institution, that usually adopts timid measures, considering the seriousness of that. It is also noteworthy that, despite jurisprudence and some legal provisions against harassment, Brazil still does not have a specific legislation to combat that type of violence, excepting to sexual harassment – briefly inserted into the Brazilian Criminal Code. Productive restructuring, under the neoliberal flexibilization bias, added to the strong patriarchal heritage that feeds gender inequalities, drive insecure and violent labor relationships, which is a fertile ground to the practice of moral and sexual harassment, with the State being co-responsible for its existence and reproduction. Therefore, a methodological perspective focused on historical-dialectical materialism was used, which, by associating diachronic analysis (of genesis and development) with a synchronic analysis (of structure and function in the current organization), allows us to assess the complete richness of social relations – which consists of going beyond the immediate appearance, seeking to reach the perception of the essence of the investigated object through analytical procedures. With this, it was intended to apprehend the mechanisms that lead to the historical and continuous exclusion of women and blacks in the Brazilian labor market. The research consisted of a bibliographic and documental survey and field research. The following categories were discussed: Work, Sexual Division of Labor, Structural Racism, Gender, Race, Class and Intersectionality, as well as the concepts of Diversity Management and Corporate Social Responsibility. In the empirical research, it was verified how the organizations from Maranhão that claim to be socially responsible are promoting equality among their staff, analyzing the implementation (or not) of internal D&I actions. The first stage of the field research collected internal data on the gender and race/color characteristics of employees at their respective hierarchical levels. After that, semi-structured interviews were carried out with the managers responsible for Human Resources (HR) of the selected organizations in order to obtain information on the implementation of internal policies or affirmative actions to promote the inclusion of women and black people. Anchored in all the information collected, it was possible to verify that companies from Maranhão need to advance a lot in relation to the development of internal policies/actions to promote D&I and combat gender and racial inequalities in the labor market. The survey results showed that companies from the private sector, and even from the public sector, present in Maranhão are very late (neglect) in the implementation of actions to include these groups, especially in racial equality policies, therefore, inequalities are continuous. for women and especially for the black population in the local market. Adopts as its assumption the Contemporary Capitalist State Theory and its determinations of nature and space, and the contradictory and complex involvement with social dumping in labor relations, as a prior phenomenon derived from the relentless practice of violation and denial of labor rights in order to achieve a potential advantage over competition. The question its analyzed from a Marxian perspective, through the use of historical-dialectical materialism and, therefore, we examine the historical designs that gives meaning to the Policy formulations as a state intervention. Thus, we start from a bibliographical and documental research, in order to allow the analysis of documents and data related do the Policy and its formulation process. Thus, it asks whether or not the policy has a propensity for naturalization and legitimation of social dumping through a state regulation practices, unfavorable to worker’s interests. It reflects about the process of institution of conciliation as a policy based on social-historical rescue that analyzes the idea of class conciliation as a culture with reflexes in the Labor Judiciary. It investigates the subject, their interests and rationalities and the way they express them in the Policy formulation process, trying to verify their influence degree on the Policy itself. Throughout the research, a historical overview of the right to health in Brazil is established, explaining how the brazilian Health System and other regulatory frameworks have been reached since the Federal Constitution of 1988. In addition, an analysis is made of the Ministry Public in Brazil, as an institution, as well as the existing instruments for extrajudicial action in the field of health, with emphasis on the design of new instruments, in addition to the existing ones, based on the need for resolutive and democratic action. Regarding the methodological course, in the qualitative research, the technical procedures used focused on the bibliographical and documentary research, complemented by a semi-structured interview and participant observation in the empirical space of the research. In the bibliographical research, we searched the works focused on the analysis of the theme, with focus for the Public Prosecution in the realization of the right to health; the documentary research was developed seeking administrative procedures in process at the 18th Specialized Justice Department of Defense for Health of São Luís, the empirical space of the research. For theoretical foundation of the investigation and the exposition of the results, Pierre Bourdieu was used, mainly the categories of field, symbolic power, symbolic violence and radical doubt; From Robert Alexy, we sought the weighting technique and Michael Foucault was considered his contribution in the order of the speech. In order to understand the changes that have taken place in the University Hospital of Federal University of Maranhão (HU-UFMA), the work focus on the investigation of a single specific objective: the change management impact-analysis regarding to the education-research-extension university tripod, and therefore as these changes interfere in health care under the Unified Health System (SUS). The work traces the historical-social framework that created the conditions for a change in social production at the international level, how these changes directly af fect the national states, and the reform agenda in health care policies under the aegis of the World Bank. The underfunding process of health care is discussed, investigating the dispute and use of the public fund, and how the historical underfunding of the health care sector has direct implications for the universalization of health care access and quality of service offered. However, the issue is treated as a management problem, which the solution imposed by the government involves the introduction of "new management models", among them, the Brazilian Hospital Services Company (EBSERH). At last, the author conducts an impact analysis of the introduction of the EBSERH in the University Hospital (HU-UFMA) concerning the university tripod. It concludes that the Brazilian Hospital Services Company presents itself as a materialization of the neoliberal politics of the public patrimony and denial of the right to health and quality education inside the University Hospitals.Item PROGRAMA BRASIL CARINHOSO: uma análise no contexto de reconfiguração da Política Social e no atendimento das demandas das mulheres-mães em São Luís/MA(Universidade Federal do Maranhão, 2017-04-18) FRANÇA, Mariana Veras; DIAS, Marly de Jesus Sá; 270444753-53; http://lattes.cnpq.br/0576152814937497The BC is a federal government program aimed at early childhood, with the aim of stimulating the creation of day care centers and opening new places in existing day care centers for children aged 0-3 and thus reducing the inequality of access to education between the poor and the rich. It is part of the programs developed by the Social Assistance Policy in the context of reconfigurations of social policies under the impositions of neoliberal capital. The objective was to analyze this Program in São Luís-MA, in the current context of Social Assistance in relation to meeting the demands of women mothers and children from 0 to 6 years of age by daycare centers in the period from 2012 to 2015. It counted on the contribution (1 public and 2 community) located in the neighborhoods of Palmeira Village, Guardian Angel and Embratel Village, 12 mothers-women with children aged 0-6 enrolled in PBF-BC and 2 representatives of the Municipal Secretariat of Education of São Luís (SEMED) and 3 pedagogical directors/coordinators of the day care centers. The conception of day care that guided the study was public policy, social and universal right of urban and rural workers (and) and children up to 5 years of age to education, which has the duty of the State to guarantee it as a public good, free and of quality. This is a critical and qualitative study, which shows that daycare continues to be a "subpriority" of municipalities, and that the Program did not cover the historical demands, because parents still find it difficult to find places in public facilities, Which entails the transfer of responsibility of the municipality to private institutions, whether philanthropic or community. And these, in turn, also showed difficulties in receiving the encouragement of FUNDEB via BC. I analyze the social representations on leisure (in) for the elderness through the perceptions that old women and old men, participants of activities in the PAI, activate about leisure while participating or not in the activities. The research methodology used was the qualitative approach, conducted during the period of March, 2014 to March, 2016, in which the empirical referential was the Program of Integrated Action for Retired People, the PAI, in the municipality of São Luís. I performed a bibliographical research on the guiding categories oldness and leisure from Pierre Bourdieu’s theoretical-methodological tools that understand the categories as social construction. Thus, categories leisure (s) and oldness (es) are understood as regions, that may be activated from different criteria; and also documentary research aiming to identify in the PAI’s written proposals the representations of leisure and oldness; and identify the activities that are considered leisure that were developed by the PAI. The participant’s observation, semi-structured interviews and informal conversations were also used as data collection source. The interviews covered 14 old women and men, retired from Maranhão’s Public State Service, that attended the recreational activities at least for one year in continuous way. Through the interviews with old women and men the intention was to identify the social representations that are presented about leisure and oldness; I conducted, also, interviews with five contributors (one supervisor and four social workers) who were responsible for planning and organization of the PAI activities, to an intention to understand the representation the contributors present about leisure and oldness. From the data collected on the interview, it was possible to detect how the activities developed by the PAI are ellaborated and that all of them are fraught by the conceptions of leisure. Through the performed interviews it was possible to identify old women and men’s representation of themselves and their perception of leisure. I conclude that the experiences of being old, of living leisure at the PAI and of experiencing the leisure activities in old age inside and outside PAI space take on meanings from dimensions of time, behavior and space. Thereby, experience of leisure doesn’t just happen on purposeful bases such as time and activity space developed in PAI, and therefore, subjective aspects like behavior, tastes, preferences and lifestyles of this social group must be taken into consideration.Item COOPERATIVISMO NOS PROCESSOS DE ORGANIZAÇÃO POLÍTICA E ECONÔMICA DOS TRABALHADORES NA LUTA CONTRA A EXPROPRIAÇÃO CAPITALISTA NO CAMPO: a resistência do Movimento dos Trabalhadores Rurais Sem Terra no Maranhão(Universidade Federal do Maranhão, 2014-05-27) TORREÃO, Marlene Corrêa; ABREU, Marina Maciel; CPF:12542334This is a study on cooperativism in the current economic and political organization of workers, having as reference the resistance waged by the MST in Maranhão. The historical background of the study is disclosed, presenting the cooperativism as a contradictory tool on the workers struggling process, to the extent that its determinants present two perspectives: one used in the free market idealistic proposals presenting a political and ideological dimension that meet capitalist interests, being currently updated in the processes of flexibilization work; the other, expresses an alternative of resistance and struggle of the workers, which might be an important tool in the context of social struggles, if it is consciously constituted. A historical recovery of cooperativism, is also carried out, as one of the models of agricultural cooperation organized by the MST since the 1980s, when there was an intense worsening of the agrarian question due to the advancement of capitalism in the countryside. The study considers the cooperativism as a major instrument of political and economic organization for farmers, even though in Maranhão this initiative has shown weakness in relation to the economic return to the cooperative members. The main limits pointed out by the leaders in the production sector of the movement, have been: technical and managerial difficulties, lack of production technologies, as well as little support given by the State through public policies that generally follow the logic of the current agricultural policy, allowing the landowner to be the major beneficiary of public funds. The data source is the Census of 2000 and 2010. In order to further investigate the phenomenon, we proceeded to the elaboration of an indicator called multidimensional Municipal Poverty Index for Maranhão (IPMM). First, we proceeded to the survey of the main explanatory approaches of the phenomenon of poverty and the main forms of measurement. It was then decided by multidimensional approach to poverty measurement purposes of the phenomenon, but without compromising the structural approach to understand their decisions and ways of overcoming. We decided to choose a multidimensional indicator due to the fact that it takes into account a larger number of indicators. Then, we described the methodology of the Index and the results have been described for both the index and for the six dimensions that comprise it. The main conclusions that came with the construction of IPMM were: a) there was a reduction in poverty both in the state of Maranhão as in all other cities, as we compare the years 2000 and 2010, b) the performance of municipalities was not homogeneous, c) the degree of poverty seems to be more intense at the municipal level than at state d) the most advanced dimensions were: access to the knowledge, child development and housing needs, whereas the least advanced were: access to work and lack of resources. It is worth noting that this program emerges the need of big business and the state to offer a response to local entrepreneurs and society in order to integrate them into the supply chains of large companies. However, to this end, we draw the path from the change in the economy, taking as starting point the private sector, which adopts the restructuring process as this new flagship model, the unbundling of the leading chains of large companies, mainly through outsourcing, thus generating a strategy of regional specialization. Given these changes, turns to examine the paradigm in relation to the State, which is undergoing deep changes, culminating with the so-called Minimum or Neoliberal State. It should be emphasized that the evaluation of the MA-developed PDF is dynamic and want to go from the general international economic relations, through the reflections of these relations in Brazil, reaching the more specific, the program exposed. Finally, the study of the PDF-MA aims to detail the dynamics of the program, building a framework of indicators and developing the theme of Sustainable Development. To undertake such research were two moments evaluative, first we make a political assessment of the policy, so you can figure out the nuances and how its implementation was determined politically, understanding how the program came into the government's agenda and what subjects interest and rationalities involved. In the second, reveals the dynamics of implementation of this policy through an evaluation process, ensuring that the means used are appropriate to the desired ends and if it was able to change the situation that gave rise to the problem program. Along the way, we used a qualitative and quantitative approach, having as research techniques, literature and documentary mode. This is a research and ethical reflection on the threat of economic "globalization" in Brazil. The right to work and work "decent" is situated in the larger context of human rights, the evolution of labor law and the current economic situation. The text prepared reports on the rise of the bourgeoisie and the capitalist exploitation of workers, since modernity, emphasizes the limits and the positive aspects of liberal constitutions and Brazilian constitutions since 1824 until 1988, stresses the importance of workers' struggles to defend the dignity of workers and their rights. The main hypothesis formulated by the author, who supervised the research, is that the new economic context of economic "globalization" of neoliberalism and social rights and the right to work "decent" are increasingly threatened. It breaks of an analysis of the historical context marked by the development of a new world-wide order based on the expansion of capitalism, trying to identify the deep economical, political and ideological transformations caused by the globalization movement and the internationalization of the capital, which has provoked mutations in the nature and functions of the national States, that are part of the global state forms regionally stablished, especifically on the cases of the European Union and Mercosouth. It is analysed as it took place to creation, construction and enlargement of the process of integration of member States of the European Union, determining its institutional-legal landmark, which provided with an opportunity for the preparation of the European Constitution, besides were identified the forms of structural and government development caused by this integration process, that has a much more political sense , under the European perspective, than properly legally. The embryonic form of the integration process of Mercosouth State members is described and the structural and governmental forms inherent to its constitution are highlighted. It observes the logic of formation of the constituent process which makes the elaboration of a Constitution for the economical block of the Mercosouth feasiable. A comparative study is made concerning the process of constituent formation on various state forms, used on the European Union and Mercosouth. Reflection of judicial decisions in social life has not been approached with the importance the matter requires, especially where the relations resulting from the conflicts between capital and work are concerned. The purpose of this paper is to draw the attention to decisions made by the Labour Federal High Court and the Regional Labour Court in Maranhão relative to precarious labour in Brazil, with emphasis on aspects such as contracting out, flexibilization of rights, poor health and hygienic conditions of workers and degrading work, which, sometimes, reaches the boundaries of slavery. The judicial posture adopted by the Labour Justice seeks to strike a balance between protecting the worker and preserving the company. Considering that the Judicial Power is part of the capitalist State, accomplishing that goal is questionable. In despite of that, the Labour Justice has developed and established itself as the branch of the Judiciary closest to social issues, not only when it plays the role of a mediator between individual and collective conflicts, but also when it, through its judges, prevents the fraud to the employment protection legislation. It shows that the program is a Corporate Social Responsibility Action (CSR), which works in partnership system within the third sector . The Education Action comprises two actions: one directs to the training of managers of public schools in Açailândia the municipality and the other, intended for training of staff of the Secretariat of the Municipality of Bom Jesus jungles of Education. On the relationships established within that program, are speeches that apparently seem to be endowed action coherence and linearity and contradictory practices that deny speech. Wonders whether the speech and the practice of social responsibility of Vale, through its historical determinants. Therefore, to obtain results, we used authors who interpret CSR as an ideological process in order to interpret the CSR Valley as a reductive ideological strategy of socio-environmental conflicts in communities headquarters of the Education Action Programme, because of the unbridled search for profit of the company.
